1. Purpose and Scope

These General Terms and Conditions of Sale (hereinafter the “GTC”) govern all sales concluded between Faubourgs de Paris, the operator of the LAPS brand (hereinafter “LAPS”), and any natural or legal person making a purchase via the website laps.fr (hereinafter the “Website”).
The GTC set out, in particular, the terms and conditions governing orders, payment, delivery, returns and the warranty for products sold by LAPS.
Any order placed on the Website implies the Customer’s full and unconditional acceptance of these GTC, to the exclusion of any other document.
The applicable GTC are those in force on the date the order is confirmed.
The products offered on the Site are intended for:

  • Consumers within the meaning of the French Consumer Code ;
  • As well as business customers, unless otherwise expressly stated.

In the event of any conflict between a translated version of these T&Cs and their French version, the French version shall prevail.

3. Products

LAPS designs and sells watches, watch accessories and related products available for purchase on the Website.
The key features of the products are set out in the product descriptions available on the Website. The Customer is required to familiarise themselves with these before placing any order. Photographs, images, videos and representations of the products are provided for illustrative purposes only and do not guarantee a perfectly identical reproduction of the product delivered, particularly with regard to :

  • colours ;
  • textures ;
  • materials ;
  • reflections ;
  • finishes ;
  • or the appearance of engravings and personalised elements.

Slight variations may occur due to :

  • technical constraints ;
  • screen display settings ;
  • or the artisanal nature of certain manufacturing or assembly processes.

Products are offered subject to availability.
LAPS reserves the right to modify the specifications of its products at any time, without such modifications affecting orders that have already been confirmed.
Information regarding water resistance, battery life, materials or product performance applies to normal use and is in accordance with the usage recommendations provided by LAPS.

4. Orders

Orders are placed directly on the Website by the Customer.
The Customer selects the products they wish to purchase, adds them to their basket and then confirms their order after checking its contents, the total price and the delivery details provided. Before the order is finally confirmed, the Customer has the opportunity to check the order details and correct any errors.

Confirmation of the order constitutes full and unconditional acceptance of :

  • these Terms and Conditions ;
  • the prices and descriptions of the products ;
  • and the obligation to pay.

An order confirmation is sent to the Customer by email to the address provided at the time of ordering.

LAPS reserves the right to refuse, suspend or cancel any order in the event of:

  • a previous dispute with the Customer ;
  • total or partial non-payment ;
  • suspected fraud ;
  • misuse of the Website ;
  • or for any legitimate reason.

The information provided by the Customer when placing the order is binding on the Customer. LAPS cannot be held liable for any consequences resulting from incorrect, incomplete or unusable information, in particular regarding the Customer’s identity or delivery address.
The order is only considered final once payment has been validated by the relevant banking institutions.

5. Prices and Taxes

Prices displayed on the Site are indicated in euros (EUR), including all taxes (VAT included), unless stated otherwise.
Shipping costs are specified before final validation of the order and charged additionally where applicable.
For orders shipped outside the European Union, customs duties, local taxes, import fees or other governmental charges may be required by local authorities. Such charges remain the sole responsibility of the Client.

The Client is solely responsible for:

  • any declarations required by competent authorities ;
  • as well as payment of any duties, taxes or fees applicable in the destination country.

LAPS reserves the right to modify its prices at any time. However, products shall be invoiced based on the rates in force at the time the order is validated.

6. Payment Terms

Orders are payable using the payment methods available on the Site at the time of ordering. Payments made on the Site are secured via the Stripe payment platform, used within the Shopify Payments infrastructure.
The Client’s banking data is processed directly by secure payment providers and never passes unencrypted through LAPS systems.
Transactions benefit from security and authentication protocols compliant with current standards, particularly regarding fraud prevention and strong customer authentication.
The total amount of the order is charged at the time the banking transaction is validated.

LAPS reserves the right to suspend or cancel any order in the event of:

  • refusal of payment authorization ;
  • payment incidents ;
  • suspicion of fraud ;
  • unauthorized use of a payment method ;
  • or total or partial non-payment.

Products remain the property of LAPS until full payment of the order price has been received.

7. Delivery

Products ordered on the Site are delivered to the address provided by the Client when placing the order.
The Client is solely responsible for the accuracy and completeness of the information provided for this purpose. In the event of an error, incomplete address or impossibility of delivery attributable to the Client, LAPS cannot be held liable for delivery failure or delay. Costs relating to reshipment may be charged to the Client.
Deliveries are made in France and in the countries offered at the time of ordering on the Site.

No delivery may be made:

  • to hotels ;
  • to P.O. boxes ;
  • or to any manifestly incomplete or inaccurate address.

Delivery times indicated on the Site or communicated to the Client are provided for informational purposes only. They may vary depending in particular on:

  • destination ;
  • product availability ;
  • activity periods ;
  • possible customization operations ;
  • customs formalities ;
  • or constraints specific to carriers.

In accordance with the French Consumer Code, and unless expressly stated otherwise, products shall be delivered no later than thirty (30) days from order validation.

In the event of unjustified delivery delay, the consumer Client may:

  • formally request that LAPS complete delivery within an additional reasonable period;
  • and, failing performance within such period, request cancellation of the sale under the conditions provided by law.

Risk transfers when the Client, or a third party designated by the Client, physically takes possession of the products.
The Client is required to inspect the package and products upon delivery.

Any apparent anomaly, including:

  • damaged package;
  • missing product;
  • damaged product;
  • or opened packaging,

must be reported without delay to the relevant carrier and to LAPS.

In the event of loss of the package during transport before delivery to the Client, an investigation may be initiated with the relevant carrier. Investigation periods may vary depending on the carrier and the destination of the order.
Upon official confirmation of the package loss by the carrier, LAPS may, depending on the situation:

  • arrange a new shipment of the product subject to stock availability ;
  • or refund the relevant order.

No claim relating to package loss may be processed before the carrier’s investigation has been completed.

For orders shipped outside the European Union, customs duties, local taxes, import fees or other charges required by local authorities may apply. Such charges remain entirely the responsibility of the Client.

LAPS cannot be held liable for delays, losses or blockages attributable to:

  • carriers ;
  • customs authorities ;
  • force majeure ;
  • or any circumstance beyond its control.

8. Customization and Engraving

Certain products offered on the Site may be customized at the Client’s request, particularly through engraving.
The Client is solely responsible for the information, text, dates or wording submitted for such customization. No modification, correction or cancellation can be guaranteed after final validation of the order and commencement of production.
Minor differences may exist between visuals displayed on the Site and the final product, notably due to:

  • technical engraving constraints;
  • materials used;
  • positioning;
  • or manufacturing processes.

In accordance with Article L221-28 of the French Consumer Code, products made according to the Client’s specifications or clearly personalized are excluded from the legal right of withdrawal.
Consequently, any order including customization validated by the Client shall be considered firm and final and may not be returned, exchanged or refunded except in the event of:

  • lack of conformity ;
  • damage observed upon delivery ;
  • or a defect affecting the delivered product.

9. Right of Withdrawal and Returns

In accordance with Articles L221-18 et seq. of the French Consumer Code, the consumer Client has a period of fourteen (14) calendar days from the date of physical receipt of the products by the Client, or by a third party designated by the Client other than the carrier, to exercise their right of withdrawal without having to justify any reason or bear any costs other than return shipping costs.
The right of withdrawal does not apply to personalized products in accordance with Article 8 of these T&C, in particular products subject to engraving or customization at the Client’s request.
To exercise the right of withdrawal, the Client must notify LAPS of their decision by e-mail to contact@laps.fr or by postal mail through an unambiguous statement expressing their intention to withdraw. Products must be returned no later than fourteen (14) days following communication of the withdrawal decision to the following address:

Returned products must:

  • be new;
  • unworn;
  • unused;
  • complete;
  • accompanied by any accessories;
  • and returned in their original packaging.

The Client is liable for any depreciation resulting from handling other than what is necessary to establish the nature, characteristics and proper functioning of the product.
Any product returned incomplete, damaged, worn, used, soiled or deteriorated may not be refunded.
Return shipping costs remain the responsibility of the Client.

LAPS recommends using a secure shipping method with tracking and insurance appropriate to the value of the returned products. LAPS cannot be held liable in the event of:

  • loss ;
  • theft ;
  • or deterioration of the return package during transport.

After receipt and inspection of the returned products, LAPS shall reimburse the amounts paid for the relevant products and, where applicable, the standard shipping costs corresponding to the least expensive delivery method offered at the time of the order.

Refunds shall be made within a maximum period of fourteen (14) days from:

  • receipt of the returned products ;
  • or receipt of proof of shipment provided by the Client.

Refunds shall be made using the same payment method as that used for the order, unless expressly agreed otherwise between the parties.

10. Legal Warranties

Products sold by LAPS benefit from the legal warranties provided under French law, including:

  • the legal warranty of conformity provided for in Articles L217-3 et seq. of the French Consumer Code ;
  • as well as the warranty against hidden defects provided for in Articles 1641 et seq. of the French Civil Code.

The consumer Client benefits from a period of two (2) years from delivery of the product to act under the legal warranty of conformity.

The Client is exempt from proving the existence of the lack of conformity during the twenty-four (24) months following delivery of the product.

In accordance with Article L217-8 of the French Consumer Code, in the event of lack of conformity, the Client is entitled to have the product brought into conformity by repair or replacement or, failing that, to a price reduction or termination of the contract under the conditions provided by law.

The Client may request repair or replacement of the product, subject to the cost conditions provided for in Article L217-12 of the French Consumer Code.

LAPS may refuse the Client’s chosen remedy if the requested solution is impossible or entails disproportionate costs, particularly in view of:

  • the value the product would have had in the absence of the defect ;
  • the significance of the defect ;
  • and the possibility of choosing the alternative remedy without major inconvenience for the Client.

The Client may obtain a price reduction or contract termination under the conditions provided for in Articles L217-14 et seq. of the French Consumer Code.

The Client may also invoke the warranty against hidden defects within the meaning of Article 1641 of the French Civil Code. In such case, the Client may choose between:

  • cancellation of the sale;
  • or a reduction in the sale price in accordance with Article 1644 of the French Civil Code.

Legal warranties apply independently of any commercial warranty granted by LAPS.

Legal warranties do not cover:

  • normal wear and tear ;
  • damage resulting from accidents, shocks or falls ;
  • abnormal or improper use ;
  • improper handling ;
  • lack of maintenance ;
  • unsuitable exposure to water, humidity or extreme conditions ;
  • consequences resulting from intervention, repair or modification carried out by an unauthorized third party;
  • or aesthetic deterioration linked to normal product use.

The Client may be requested to provide:

  • the order number;
  • photographs of the relevant product;
  • as well as any useful information required for examination of the claim.

11. Commercial Warranty and After-Sales Service

Independently of the applicable legal warranties, LAPS grants a commercial warranty covering manufacturing and material defects under normal use conditions.
Unless otherwise stated, the commercial warranty applies for a period of twenty-four (24) months from the date of delivery of the product.
The commercial warranty is provided free of charge and accompanies each relevant product.

The commercial warranty exclusively covers defects affecting:

  • the movement ;
  • internal components ;
  • or elements presenting a manufacturing or assembly defect recognized by LAPS.

The commercial warranty does not cover:

  • normal wear and tear ;
  • scratches ;
  • impacts ;
  • damage resulting from falls or shocks ;
  • damage resulting from improper use ;
  • lack of maintenance ;
  • excessive exposure to humidity, water or magnetic fields ;
  • damage resulting from unauthorized intervention ;
  • straps, consumables or components subject to normal wear ;
  • nor aesthetic alterations linked to product use.

The water resistance of watches is guaranteed in accordance with the technical specifications indicated for each model at the time of purchase.

LAPS nevertheless recommends regular water resistance checks, particularly after:

  • a shock ;
  • opening of the case ;
  • or prolonged exposure to water.

Damage resulting from use contrary to water resistance recommendations is not covered by the commercial warranty.

Any opening, modification, dismantling or repair carried out by a workshop not approved by LAPS shall void the commercial warranty.

For any after-sales service request, the Client must contact LAPS at : contact@laps.fr specifying:

  • the order number ;
  • the relevant model ;
  • a description of the issue encountered ;
  • as well as photographs of the product where necessary.

After analysis of the product, LAPS may decide:

  • to repair the product ;
  • to replace it ;
  • to replace only certain components ;
  • or to propose an equivalent solution adapted to the situation.

Shipping costs to the after-sales service center may remain the responsibility of the Client, unless otherwise required by law or specifically agreed by LAPS.

The commercial warranty is additional to legal warranties and does not replace them.

12. Liability

LAPS cannot be held liable for damages resulting from :

  • improper use of products ;
  • lack of maintenance ;
  • negligence ;
  • improper handling ;
  • or use contrary to recommendations communicated by LAPS.

LAPS shall not be held liable in the event of :

  • force majeure ;
  • disruption or interruption of transportation or communication networks ;
  • temporary unavailability of the Site ;
  • or any event beyond its control.

Photographs, descriptions, graphic representations and information presented on the Site are provided for informational purposes only. Despite the care taken in their presentation, minor differences may exist between the visuals displayed and the delivered products.

To the extent permitted by applicable law, LAPS shall not be liable for indirect or consequential damages, including:

  • loss of business ;
  • loss of use ;
  • loss of data ;
  • loss of opportunity ;
  • or commercial prejudice.

The limitations of liability provided for in this article shall not apply:

  • in the event of gross negligence or wilful misconduct ;
  • to bodily injury ;
  • or where applicable law prohibits such limitation.

13. Intellectual Property

All elements present on the Site, including:

  • trademarks ;
  • logos ;
  • names ;
  • designs ;
  • models ;
  • photographs ;
  • videos ;
  • illustrations ;
  • texts ;
  • editorial content ;
  • as well as the overall architecture of the Site,

are protected by applicable intellectual property laws and remain the exclusive property of LAPS or their respective owners.
Any reproduction, representation, distribution, adaptation, exploitation or use, in whole or in part, of any element of the Site without prior written authorization from LAPS is strictly prohibited. Any unauthorized use may give rise to legal proceedings in accordance with applicable laws.

14. Personal Data

As part of the use of the Site and order processing, LAPS may collect and process certain personal data relating to Clients. Such processing is carried out in accordance with applicable personal data protection regulations, particularly the General Data Protection Regulation (GDPR).
The terms governing the collection, processing, retention and protection of personal data are detailed in the Privacy Policy available on the Site.

The Client notably benefits from:

  • a right of access ;
  • a right to rectification ;
  • a right to erasure ;
  • a right to restriction of processing ;
  • a right to object ;
  • as well as a right to data portability, under the conditions provided by applicable regulations.

15. Consumer Mediation

In accordance with the provisions of the French Consumer Code, the consumer Client has the right to use, free of charge, a consumer mediator with a view to amicably resolving any dispute with LAPS.

The contact details of the competent mediator shall be communicated to the Client upon request or once officially designated by LAPS.

16. Applicable Law and Jurisdiction

These T&C are governed by French law.

In the event of a dispute, the parties shall seek an amicable solution before initiating legal proceedings.

Failing amicable resolution, competent courts shall be determined in accordance with applicable legal rules.

Consumer Clients benefit from any mandatory protective provisions applicable in their country of residence within the European Union.

17. Updates to the T&C

LAPS reserves the right to modify these T&C at any time.

The applicable T&C are those in force on the date the order is validated by the Client.

The latest version of the T&C is accessible at any time on the Site.
